NOTICE OF REAL PROPERTY CERTIFICATE SALE

LAGRANGE COUNTY, INDIANA

STATE OF INDIANA, COUNTY OF LAGRANGE, SS:

Notice is hereby given that each parcel of real property in the following list will be offered by the LaGrange County Commissioners (“Commissioners”) at public auction to the highest bidder subject to the right of redemption. This auction will begin at 10:00 AM on Thursday, April 19, 2012 in the Commissioners’ Room, Annex Building, in the City of LaGrange, Indiana. The sale will continue until all tracts and real property have been offered for sale.

Each parcel of real property in the following list will be sold for an amount that is not less than the amount of the minimum bid listed for that parcel.

If the real property is sold in the certificate sale, the amount required to redeem such property will be:

1.     The amount of the original minimum bid from the tax sale, as prescribed in IC 6-1.1-24-5(e);

2.     Ten percent (10%) of the amount for which the certificate is sold;

3.     Attorney’s fees and costs of giving notice under IC 6-1.1-25-4.5;

4.     Costs of a title search or of examining and updating the abstract of title for the tract or item of real property;

5.     All taxes and special assessments on the tract or item of real property paid by the purchaser after the sale of the certificate plus interest at the rate of 10% per annum on the amount of taxes and special assessments paid by the purchaser on the redeemed property; and

6.     All costs of sale, advertising costs, and other expenses of the county directly attributable to the sale of certificates of sale.

For parcels that are sold, the period of redemption will expire one-hundred twenty (120) days after the date of sale.

If a tract or item of real property is sold for more than the minimum bid and the property is not redeemed, the owner of record of the tract or item of real property who is divested of ownership at the time the tax deed is issued may have a right to the tax sale surplus.

The Commissioners specifically reserve the right to withhold from the sale any parcels that have been listed in error or that otherwise become ineligible for sale prior to Thursday, April 19, 2012.  LaGrange County, Indiana does not warrant the accuracy of the street address or common descriptions of the parcels of real property.

This notice of real property certificate sale, and the certificate sale itself, are undertaken and will be conducted pursuant to the requirements of the laws of Indiana which regulate the sale of land for delinquent taxes, pursuant to IC 6-1.1-24-6.1 et seq.

TREASURER’S NOTICE TO OWNERS AND PROSPECTIVE BUYERS

The Treasurer of LaGrange County (the "Treasurer") requires that payment on all parcels eligible for Certificate Sale be made by Cash or Cashier’s Check.

Property owners may withdraw their parcel from the Certificate Sale by paying all delinquent taxes, penalties, tax sale advertising cost, and special assessments, prior to the start of the Certificate Sale.  Payments may be made in the LaGrange County Treasurer’s office through 4:00 PM on Wednesday, April 18, 2012.

All Certificate buyers will be required to use a Treasurer-assigned bid number to be eligible to bid on a parcel. Certificate buyers may obtain a bid number from the Treasurer in the Commissioners’ Room, Annex Building, LaGrange, Indiana on Thursday, April 19, 2012, prior to bidding at the Certificate Sale.

Certificate buyers must pay with the correct type of payment no later than 4:00 PM on Thursday, April 19, 2012. A high bidder who fails to pay the bid price in acceptable funds by 4:00 PM on Thursday, April 19, 2012 must pay a penalty of 25% of the amount of the bid.

Information about the conduct of the LaGrange County Certificate Sale will be offered at 9:30 AM on Thursday, April 19, 2012, in the Commissioners’ Room, Annex Building. This session will continue until the sale commences at 10:00 AM.
