NOTICE OF SHERIFF'S SALE

     By virtue of a certified copy of a decree to me directed from the Clerk of the Circuit Court of LaGrange County, Indiana, in Cause Number 44C01-1107-MF-00048, wherein US Bank NA ND was Plaintiff, and James A. Akers, Diane L. Dearmond-Akers and Mortgage Electronic Registration Systems, Inc., were the Defendants, requiring me to make the sum as provided for in said Decree with interest and costs, I will expose at public sale to the highest bidder, on the 18 day of April, 2012, at 10 A.M. of said day, at the 875 S State Road 9, LaGrange, IN 46761, the fee simple of the whole body of Real Estate in LaGrange County, Indiana:

Lots Two Hundred Forty-Six (246) and Two Hundred Forty-Seven (247) in the Original Plat of the Village of Lima, now Howe, Excepting Thirteen (13) feet off the West side of both Lots.

and commonly known as: 404 7th Street, Howe, IN 46746.

     Subject to all easements and restrictions of record not otherwise extinguished in the proceedings known as Cause # 44C01-1107-MF-00048 in the Circuit Court of the County of LaGrange Indiana, and subject to all real estate taxes, and assessments currently due, delinquent or which are to become a lien.

     Said sale will be made without relief from valuation or appraisement laws. If the sale is set aside for any reason, the Purchaser at the sale shall be entitled only to a return of the deposit paid. The Purchaser shall have no further recourse against the Mortgagor, the Mortgagee, or the Mortgagee’s Attorney.
