NOTICE OF SHERIFF’S SALE

        By virtue of a certified copy of a decree to me directed from the Clerk of the Circuit Court of LaGrange County, Indiana, in Cause No. 44C01-1005-MF-46, wherein Beneficial Financial I Inc. successor by merger to Beneficial Indiana Inc. D/B/A Beneficial Mortgage Co. was Plaintiff, and Lon L. Aldrich, Jaima Aldrich, The State of Indiana through its Department of Revenue and The United States through its Internal Revenue Service, were the Defendants, requiring me to make the sum as provided for in said Decree with interest and costs, I will expose at public sale to the highest bidder, on the 14 day of Nov, 2012, at 10 AM. of said day, at the 875 S State Road 9, LaGrange, IN 46761, the fee simple of the whole body of Real Estate in LaGrange County, Indiana:

Part of the Northeast Quarter of the Northeast Quarter of Section 23, Township 38 North, Range 9 East, Lima Township, LaGrange County, Indiana, described as follows: Beginning at a Harrison Monument marking the Northeast corner of said Northeast quarter; thence South 1 deg. 54’ 19” East along the East line of said Northeast quarter 831.72 feet to a MAG nail at the Northeast corner of land owned by Phillip D. Curtis and Barbara J. Curtis as recorded in Deed Instrument #88-10-245; thence following the boundary of said Curtis-owned land through the following two courses, South 88 deg. 29’ 14” West a recorded and maintained distance of 667.00 feet to a #5 Doyle rebar; and South 2 deg. 09’ 32” East a recorded and maintained distance of 500 feet to a #5 Doyle rebar on the South line of said Northeast quarter of said Northeast quarter; thence South 89 deg. 36’ 02” West along said South line 651.64 feet to a #5 Doyle rebar at the Southwest corner of said Northeast quarter of said Northeast quarter; thence North 1 deg. 50’ 19” West along the West line of said Northeast quarter of said Northeast quarter 979.71 feet to a #5 Doyle rebar at the Southwest quarter of land owned by Russell E. Rinehart as recorded in Deed Instrument #93-5-255; thence following the boundary of said Rinehart-owned land through the following two courses, North 89 deg. 27’ 13” East a recorded and maintained distance of 361.50 feet to a #5 Doyle rebar; and North 1 deg. 50’ 19” West a recorded and maintained distance of 361.50 feet to a MAG nail on the North line of said Northeast quarter; thence North 89 deg. 27’ 13” East (record bearing) along said North line 953.50 feet (recorded 960.69 feet) to the point of beginning. LESS AND EXCEPT: A part of the Northeast Quarter of the Northeast Quarter of Section 23, Township 38 North, Range 9 East, Lima Township, LaGrange County, Indiana, described as follows: Commencing at the Northeast corner of the Northeast Quarter of said Section 23; thence due South (assumed bearing) on the East line of the Northeast Quarter of said Section 23, a distance of 573.05 feet to the point of beginning of this description; thence continuing due South on said East line, 208.73 feet; thence due West 233.73 feet to a 5/8” capped rebar; thence due North, parallel with said East line, 208.73 feet to a 5/8” capped rebar; thence due East 233.73 feet to the point of beginning Excepting the East 25.00 feet therefrom for roadway purposes. Containing 1/00 acres, more or less.

    Subject to all easements and restrictions of record not otherwise extinguished in the proceedings known as Cause # 44C01-1005-MF-46 in the Circuit Court of the County of LaGrange Indiana, and subject to all real estate taxes, and assessments currently due, delinquent or which are to become a lien.

    Said sale will be made without relief from valuation or appraisement laws. If the sale is set aside for any reason, the Purchaser at the sale shall be entitled only to a return of the deposit paid. The Purchaser shall have no further recourse against the Mortgagor, the Mortgagee, or the Mortgagee’s Attorney.
