LEGAL NOTICE
Notice is hereby given that pursuant to I.C. §6-1.1-12.1 et seq (the “Act”), the Town Council of the Town of Shipshewana, Indiana, on the 26th day of July, 2012, adopted a Declaratory Resolution pursuant to the Act establishing an area as an Economic Revitalization Area for the purposes of granting a deduction from assessed valuation of property - tax abatement. The area designated as an Economic Revitalization Area is as follows:
A tract of land located in the Southwest Quarter of Section 2, Township 37 North, Range 8 East, in LaGrange County, the State of Indiana, more fully described as follows: Beginning at the Northwest corner of parcel I in the Replat of the Third Addition to Punkin Vine Junction as recorded in the LaGrange Plat Book 11, page 28 marked by a rebar bound this survey; thence North 00 degrees 02’ 47” East (record) along the East line of Tuscany Drive for 430.30 feet to a rebar set this survey; thence North 89 degrees 48’ 22” East along the South line of a strip of land conveyed to the Town of Shipshewana per LaGrange County Document Record #95-12-494 for 450.71 feet to a rebar set this survey; thence South 00 degrees 02’ 47” West parallel to the East line of Tuscany Drive for 432.08 feet to a rebar found this survey; thence North 89 degrees 58’ 01” West along the North line of Parcel I in said Replat of the Third Addition to Punkin Vine Junction for 450.71 feet to the Point of Beginning.
Subject to all easements, assessments, highways, restrictions, and other limitations of record, or claims of easements not shown by the public records.
Subject to the Easement to Michigan-Wisconsin Pipe Line Company dated December 6, 1971 and recorded February 13, 1972 in Miscellaneous Record “FF”, page 504, Amended by Instrument #76-8-285 on August 30, 1976.
The area designated as an Economic Revitalization Area is more commonly known as, 955 N Tuscany Drive, Shipshewana, Indiana.
Notice is further given that on the 23rd day of August, 2012, at 6:00 p.m. in the Town Hall Meeting Room, 345 N. Morton Street, Shipshewana, Indiana, the Shipshewana Town Council will hold a public hearing, which may be adjourned from time to time, to hear all interested persons and shall consider all written remonstrances and objections as have been filed and, after considering the same, shall take final action determining whether the qualifications for an Economic Revitalization Area have been met by either confirming, modifying and confirming or rescinding said Declaratory Resolution. Notice is further given that the Declaratory Resolution and a description of the affected area is available and can be inspected in the County Assessor’s Office, 114 West Michigan Street, LaGrange, Indiana.
