ORDINANCENO. IV-A-1-a(34)

ANORDINANCE CREATING CERTAIN TRAFFIC RESTRICTIONSFORTRUCKS,MODIFYINGSNOWREMOVALFROMSIDEWALKS,AND AMENDING CHAPTERS 70 AND 94 OFTHESHIPSHEWANATOWNCODE

WHEREAStheTownCouncil(hereinafter"Council")oftheTownofShipshewana (hereinafter"Town")hastheauthorityunderIndianaCode§9-21-1-2toadoptbyordinance additionaltrafficregulationswithrespecttohighwaysunderitsjurisdiction;and

WHEREAStheCouncilhastheauthorityunderIndianaCode§6-9-2-7toregulatetheuseofpublicways;and

WHEREAStheCouncilhastheauthorityunderIndianaCode§36-8-2-4to regulate conduct, or use or possession of property,thatmightendangerthepublichealth,safety,orwelfare;and

WHEREAStheCouncilwishestoamendChapter70oftheTownCodeconcerning generalprovisionsoftheTrafficCodeinordertoimprovelargevehicletraffic;and

WHEREAStheCouncilwishestoadda newsectiontotheTownCodeconcerning generalparkingprovisions;and

WHEREASthe CouncilwishestoamendChapter94oftheTownCodeconcerning generalprovisionsrelatingtosnowaccumulationonsidewalksinorderto moreaccurately managetargetbehavior.

NOW,THEREFORE,BEITORDAINEDBYTHETOWNCOUNCILOF THE TOWNOFSHIPSHEWANA, INDIANAASFOLLOWS:

SECTIONI.-REPEALOFOLDLANGUAGE.

Sections70.02,70.04,and70.13ofTitleVIIoftheShipshewanaTownCodeof 1997are herebyrepealedintheirentirety.Sections94.45and94.47ofTitleXIoftheShipshewana TownCodeof1997areherebyrepealedintheirentirety.

SECTIONII.-INSERTINGAMENDED LANGUAGE

ONDEFINITIONS.

Section70.02oftheShipshewanaTownCodeof1997shallbeandisherebyimplementedand enactedtoreadasfollows:

§70.02INTERPRETATIONOFWORDSANDPHRASES.

Asusedinthischapter,wordsandphrasesshallhavetheirordinarymeaningexceptthat,incase ofconflict,thestatutorydefinitionscontained in I.C. §9-13-2, as amended, shallprevail.

Notwithstandinganythingtothecontraryintheprevioussentence,ifawordisspecifically definedinasectionorscheduleofthischapter,thatdefinitionshallcontrolinsteadthroughout thatrespectivesectionorschedule.

SECTIONIII.-INSERTINGAMENDEDLANGUAGE

ONWEIGHTS/AXLES.

Section70.04oftheShipshewanaTownCodeof 1997shallbeandishereby implemented and enactedtoreadasfollows:

§70.04   TRAFFIC RESTRICTIONS FORVEHICLES WITH THREEOR MOREAXLES.

A.        Definition.Asusedinthissection,"throughtraffic"refers to trafficinitiatedatand destinedforpointsoutsidetheTown.

B.        Unless a detour route has been posted or a police officer otherwise directs, through trafficisherebyprohibitedforallmotorvehicleswiththree(3)ormoreaxlesexceptfor thefollowing Town streets:MainStreet,DepotStreet,MiddleburyStreet,VanBuren Street,NorthVillageDrive,FarverStreet,NorthandSouthMortonStreet,andNorth Street.

ON STREETSIGNS.

Section70.13oftheShipshewanaTownCodeof1997shallbeandisherebyimplementedand enactedtoreadasfollows:

§70.13STREETSIGNS.

A.        Definition.Asusedinthissection,theword"sign,"inadditiontoitsordinarymeaning, includes,butis notlimitedtoanypaint,device,ormark,etc.,thatispostedona sidewalk,curb,streetorpoleorsimilarstructureordevicethatismeanttoconvey informationorinstructionsfromtheTowntothepersonswithintheTown.

B.        TheTownStreetDepartment shallpostsignstonotify pedestriansanddriversofthe trafficandparkingregulationslistedintheTownCode.

C.        TheTownCouncilmayordertheTownStreetDepartmenttopostnewsignsthatcontrol trafficorparkingwheretheyfindthat a sign would diminish or eliminate a dangerous situation ortrafficcongestion.

D.        AllpersonsshallobeyallapplicableTowntrafficandparkingsigns.

Section70.14oftheShipshewanaTownCodeof1997shallbeandisherebyimplementedandenactedtoreadasfollows:

§70.14PROHIBITEDPARKING.

A.        Noparkingshallbeallowedinanyalleyexceptformakingdeliveries.

B.        Noparkingshallbeallowedwithinfifteen(15)feetofanyfirehydrant.

C.        Noparkingshallbeallowedwithinsix(6)feetofanydriveoralley.

D.        Noparkingshallbeallowedonthetraveledportionofanystreet.

E.        NoparkingshallbeallowedinviolationofanyTownparkingsignage.

SECTIONV.-INSERTINGAMENDEDLANGUAGE

ONSIDEWALKDEFINITIONS.

Section94.45oftheShipshewanaTownCodeof1997 shallbeandisherebyimplementedand enactedtoreadasfollows:

§94.45DEFINITIONS.

Asusedinthissubchapter,thefollowingtermsshallbedefinedasfollows:

(A)      Hazardouselements.Hazardouselementsspecificallyreferto,butarenotbelimitedto, hail,frozenwater,grease,oranymaterialwhichcausesthesidewalktobecomeslippery orotherwisedangerousforusebythepublic.

(B)      Property. Exceptwhenusedinsection94.49,"property"includeseverylot,vacantlot, house,store,orotherbuilding.

(C)      Responsible person. Aresponsiblepersonisthepersonwhoowns,manages, leases, and/orisinchargeof aproperty.

(D)      Rubbish.Rubbish,includes,butisnotlimitedto,suchmatterasashes,cans,bottles, metalwaste, brokenglass,allkindofgarbage,dirt,sweepings,boxes,lumber,wood, leaves,grass,weeds,paper,andlitterofanykind.

(E)      Shoppingdistrict.Theshoppingdistrictreferstotheareaasbounded by either side of W.MiddleburySt.,N.VanBurenSt.,MortonSt.,andDepotSt.

(F)       Sidewalk. A sidewalk is the cement or asphalt pedestrian pathway or walkway borderinganygivenpropertyonanyorallsides.

SECTIONVI.-INSERTING AMENDEDLANGUAGE

ONSIDEWALKSNOWREMOVAL.

Section94.47oftheShipshewanaTownCodeof1997shallbeandisherebyimplementedandenactedtoreadasfollows:

§94.47CLEARINGSIDEWALKS OFSNOW,ICE,RUBBISH,ETC.

(A)      Eachresponsiblepersonofanypropertyintheshoppingdistrictshallensurethatthe sidewalk in front of that property remain clear of snow, ice and other hazardous elements from8:00a.m.to6:00p.m.eachday.

(B)      Eachresponsiblepersonofanypropertywithinathousand(1,000)feetofaschoolshall ensurethatthesidewalkinfrontofthatpropertyisclearedofsnow,ice,andother hazardouselementsatleastonceeachday.

(C)      EachresponsiblepersonofanypropertyintheTownshallatalltimesensurethatthe sidewalkinfrontofthatpropertyremain clearfromrubbish.

SectionVII-EffectonPriorLaw.

Theexpressorimpliedrepealoramendmentbythisordinanceofanyotherordinanceorpartof anyotherordinancedoesnotaffectanyrightsorliabilitiesaccrued,penaltiesincurred,or proceduresbegunpriortotheeffectivedateofthisordinance.Thoserights,liabilities,and proceedingsarecontinued,andpenaltiesshallbeimposedandenforcedundertherepealedor amendedordinanceasifthisordinancehadnotbeenadopted.

SectionVIII – Severability.

No partofthisordinanceshallbeinterpretedtoconflictwithfederal,state,orlocallaws, andall reasonableeffortsshouldbemadetoharmonizethesame.Shouldanycourtofcompetent jurisdictionadjudge anypart ofthisordinanceinvalid,suchdecisionshallnot affectthevalidity oftheordinanceasawhole,oranyotherportionthereof,andforthispurposetheprovisionsof thisordinanceareherebydeclaredtobeseverable.

SectionIX – EffectiveDate.

Thisordinanceshallbecomeeffectiveuponfinalpassagehereof,publication,and withrespect toaparticularviolation,thepostingofanynecessarysignage.
