NOTICE OF ADOPTION OF ORDINANCE

IMPOSING PENALTY OR FORFEITURE

               NOTICE is hereby given that the Town Council of the Town of Middlebury, Indiana has passed the following Ordinance on July 2, 2012 for which violations are subject to the penalties and forfeitures as provided by Indiana Code.  The Ordinance is effective immediately following publication and posting as provided by the Indiana Code.  The Ordinance is as follows:

               AMENDMENT OF ORDINANCE No. 183

TRAFFIC CONTROL ORDINANCE

SPEED LIMIT

               WHEREAS, Spring Meadow Farm Drive is located in an urban district within the Town of Middlebury, Indiana;

               WHEREAS, the Middlebury Town Marshal has conducted a review and has recommended that the speed limit be established on Spring Meadow Farm Drive and set at 25 miles per hour from State Road 13 (Main Street) to its terminus in both directions;

NOW, THEREFORE, BE IT ORDAINED that the speed limit be established on Spring Meadow Farm Drive and set at 25 miles per hour from State Road 13 (Main Street) to its terminus in both directions and that the Middlebury Public Works Department and/or Marshal’s Office is directed and authorized to erect speed limit signs at the aforesaid locations pursuant to I.C. 9-21-1-3 and that persons disobeying such traffic control devices be subject to the penalties and forfeitures specified in the Uniform Act Regulating Traffic on Streets and Highways of the State of Indiana.

               ORDAINED this 2nd day of July, 2012.
