Ordinances - Firearms in county buildings

 

COUNTYOF LAGRANGE

ORDINANCE  2012-05-07

AN ORDINANCE  AMENDING ORDINANCE NO. 2011-10-3E REGARDING THE REGULATION OF FIREARMS IN COUNTY BUILDINGS.

WHEREAS, the County of LaGrange, Indiana (the “County”) has hereto before adopted Ordinance No. 2011-10-3E which amended certain County ordinances regarding the possession of firearms (as defined in I.C. §35-47-1-5) in buildings owned, leased, operated, occupied, managed, or controlled by the County; and

WHEREAS, the County now desires to enforce certain provisions in said Ordinance by setting forth a penalty for violation of the same. 

NOW, THEREFORE, BE IT RESOLVED AND ORDAINED BY THE BOARD OF COMMISSIONERS OF THE COUNTY OF LAGRANGE, INDIANA, THAT:

SECTION I

       Section IV Ordinance No. 2011-10-3E shall be deleted in its entirety and replaced as follows:

(A)       All individuals, other than a law enforcement officer on duty and performing his/her official duties, a circuit or superior court judge performing his/her official duties, or a County prosecutor performing his/her official duties, shall be prohibited from possessing any firearm in the LaGrange County courthouse building. In addition, all individuals attending a public meeting shall be prohibited from intentionally displaying a firearm at the public meeting. In addition, nothing within this Ordinance shall be interpreted to conflict with the LaGrange County Personnel Policies Handbook as it relates to employees of the County and the prohibition of possession of firearms on County property.

(B)         It is an infraction for any person to violate this section of this Ordinance. Any individual who shall violate this section of this Ordinance, upon conviction thereof, shall be punished by a fine of not more than Two Thousand Five Hundred Dollars ($2,500.00).

SECTION II

       All other parts of Ordinance No. 2011-10-3E not herein amended shall remain in full force and affect.

SECTION III

       No part of this Ordinance shall be interpreted to conflict with federal, state, or local laws, and all reasonable efforts should be made to harmonize the same.  Should any section or part thereof of this Ordinance be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the validity of the Ordinance as a whole, or any portion thereof other than that portion so declared to be invalid, and for this purpose the provisions of this Ordinance are hereby declared to be severable.

SECTION IV

       This Ordinance shall be effective upon promulgation accord­ing to law.
