NOTICE OF ADOPTION OFAN ORDINANCE BY THE BOARD OF COMMISSIONERS OF ELKHART COUNTY, INDIANA, ADOPTING THE 2017 STREET STANDARDS WHICH PRESCRIBE A FINE, PENALTY, OR FORFEITURE FOR VIOLATIONS THEREOF
NOTICE IS HEREBY GIVEN that on the 17th day of April, 2017, the following Ordinance was adopted by the Board of Commissioners of the County of Elkhart, Indiana, to-wit:
AN ORDINANCE OF THE COUNTY OF ELKHART, INDIANA ADOPTING
THE 2017 STREET STANDARDS
WHEREAS Indiana Code Sections 36-1-3 et seq. permit any county in the State of Indiana to exercise any power or perform any function necessary to the public interest in the context of its county or internal affairs, which is not prohibited by the Constitution of the United States or of the State of Indiana, or denied or pre-empted by any other law, or is not expressly granted by any other law to another governmental entity;
WHEREAS the Board of Commissioners of the County of Elkhart, Indiana is the County executive and legislative body and is by law authorized to adopt ordinances and resolutions for the public health, safety, and general welfare of its residents;
WHEREAS the Elkhart County Highway Department has reviewed and updated its Street Standards and recommends their adoption effective May 1, 2017;
WHEREAS the Board of Commissioners of the County of Elkhart, Indiana deems it reasonable and appropriate to revise and update the Street Standards effective May 1, 2017;
NOW, THEREFORE, BE IT ORDERED, ESTABLISHED, RESOLVED, AND ORDAINED by the Board of Commissioners of the County of Elkhart, Indiana as follows:
1. That the Elkhart County Roads Guidelines and Standards for Design and Public Improvement attached hereto* and identified as the “Street Standards” are hereby incorporated herein by reference and approved and adopted effective May 1, 2017.
2. This Ordinance is effective upon its date of adoption.
* The Elkhart County Roads Guidelines and Standards for Design and Public Improvement are available for inspection and copying at the offices of the Elkhart County Auditor, Elkhart County Administration Building, 117 N. Second Street, Goshen, IN 46526 and at the offices of the Elkhart County Highway Department, 610 Steury Ave., Goshen, IN 46528.
