NOTICE OF DETERMINATION TO CONSTRUCT
AND FINANCE ADDITIONS AND IMPROVEMENTS TO
THE MIDDLEBURY SEWAGE WORKS AND THE ADOPTION
AND PURPORT OF THE ORDINANCE AUTHORIZING SAME
Property owners, ratepayers and other interested parties in or served or to be served by the sewage works of the Town of Middlebury, Indiana, are hereby notified that on July 2, 2012, the Town Council adopted Ordinance No. 543 thereby determining to construct additions and improvements to the Town's sewage works including the construction of additions and expansion to the treatment capacity of the Middlebury WWTP along with making improvements pertaining to certain mains and lift stations. The WWTP design average and peak hourly wastewater flow capacities will be increased. The design average and maximum monthly pollutant loading capacities of the WWTP will be increased for the projected 20-year planning period. Improvements will be made to the influent pump station and headworks building, oxidation ditch, clarifiers, UV disinfection system, chemical feed system, sludge transfer pump station, aerobic digesters, RAS/WAS pump stations, sludge dewatering system, effluent pipe, site drainage, site roads and sidewalks, SCADA system, electrical system, site lighting, aerobic digester blowers, and other plant and site features. The Popcorn Lift Station will be eliminated and replaced with a gravity interceptor sewer main. A new force main will be installed from the North Lift Station to the WWTP. Improvements will be made at the North, Spring Valley 1, Spring Valley 2, Antler, and Hoover Lift Stations to enhance operations and address control, pump, hydrogen sulfide, access, and other issues. In addition, all related improvements, additions, equipment and appurtenances shall be included to accomplish the projects described above ("Project") pursuant to plans and specifications prepared by Donahue & Associates, consulting engineers of Indianapolis, Indiana.
The total estimated cost of the Project is estimated not to exceed $10,260,000. Ordinance No. 543 further directed that the cost of the Project be financed by the issuance of sewage works revenue bonds, in one or more series, in an aggregate amount not to exceed $10,260,000, which bonds will be payable from the net revenues of the sewage works. The bonds shall be sold at either a competitive sale or a negotiated sale to the Indiana Finance Authority as part of the SRF Program at an interest rate not to exceed 6% per annum and shall mature over a period not to exceed twenty years after completion of the Project. Copies of the plans, specifications, cost estimates and of Ordinance No. 543 are on file in the office of the Clerk-Treasurer and are available for inspection by any interested parties during regular business hours. Objections to the Project and the bonds may be filed in the time and manner provided by the Indiana Code, Title 36, Article 9, Chapter 23.
