LEGAL NOTICE OF ADOPTION OF AMENDATORY

DECLARATORY RESOLUTION BY THE MIDDLEBURY

REDEVELOPMENT COMMISSION AMENDING THE

ELROY DRIVE INDUSTRIAL PARK TIF DISTRICT

TO:          Citizens of Middlebury, Indiana

Property Owners in Amended Elroy Drive Industrial Park TIF District

               All other interested parties

               NOTICE IS HEREBY GIVEN that the Middlebury Redevelopment Commission adopted on November 29, 2012 an “Amendatory Declaratory Resolution” amending the economic development area for the Elroy Drive Industrial Park TIF District.

               The Elkhart County Plan Commission on the 13th day of December, 2012 adopted a Written Order consistent with Indiana Code Section 36-7-14-16 approving the Amendatory Declaratory Resolution for the Elroy Drive Industrial Park TIF District.  The Town Council of the Town of Middlebury, Indiana issued its Resolution approving the Written Order of the Plan Commission pursuant to Indiana Code Section 36-7-14-16(b) on the 17th day of December, 2012 for the Elroy Drive Industrial Park TIF District.

               Generally stated, the Amendatory Declaratory Resolution confirms the findings for the Elroy Drive Industrial Park TIF District and amends the economic development area to include additional real estate in the Jayco Industrial Complex, along Bontrager Drive, and Industrial Park East Drive in the Town of Middlebury as reflected in the legal description and plat attached to the Amendatory Declaratory Resolution.  The Amendatory Declaratory Resolution otherwise does not change the Elroy Drive Industrial Park TIF District.  The Amendatory Declaratory Resolution declares that the Elroy Drive Industrial Park TIF District is benefited by the economic development plan, which plan is of public utility and benefit, and which plan cannot be achieved by regulatory processes or by the ordinary operation of private enterprise without resort to the powers and authorities allowed by the Middlebury Redevelopment Commission under Indiana Code Section 36-7-14 et seq.

               Maps and plats pertaining to the Elroy Drive Industrial Park TIF District can be inspected at the Middlebury Town Hall, 418 N. Main Street, Middlebury, Indiana 46540.

               The Middlebury Redevelopment Commission will receive and hear remonstrances and objections from persons interested in or affected by the proceedings pertaining to the proposed Amendatory Declaratory Resolution and will determine the public utility and benefit of the Amendatory Declaratory Resolution.  The public hearing to be conducted by the Middlebury Redevelopment Commission, at which time it will receive and hear remonstrances and objections, and address the public utility and benefit of the Amendatory Declaratory Resolution, shall be on the 24th day of January, 2013 at 7:00 a.m. at the Middlebury Town Hall, 418 N. Main Street, Middlebury, Indiana 46540.

               A copy of this Notice of Hearing shall be filed in the office of the Elkhart County Plan Commission, Elkhart County Board of Zoning Appeals, Elkhart County Department of Planning and Development, Elkhart County Building Department, Elkhart County Building Commissioner, Elkhart County Department of Storm Water Management, Middlebury Public Works Department, Elkhart County Health Department, Middlebury Park Department, Elkhart County Surveyor, the Middlebury Town Council, and the Middlebury Water and Sewer Utilities, pursuant to Indiana Code Section 36-7-14-17.
